In what condition should we return the rented apartment when we leave? Do we have to return the apartment painted?


The answer is no. The tenant is not obliged to return the apartment repainted.


Painting is considered a conservation work, and article 21 of of Law 29/1994, of Urban Leases. says that this must be assumed by the landlord.


When you leave, the apartment must be in normal conditions, considering the time you have lived there. The tenant is not responsible for the wear and tear of the apartment, which is the result of the passage of time, and this includes the painting of the walls.


It is a different matter if there has been negligence on the part of the tenant. For example, if they have washed the wall with an abrasive product. In such cases, the tenant must indeed fix and paint the wall.


And what about the color? Do you have to return the apartment painted the same color as when you rented it?


According to the majority jurisprudence, it is not necessary, as the change of color is not considered an essential alteration of the dwelling. In any case, it is best to inform the landlord when you change the color, especially if the contract specifies the original color and the obligation to maintain it.
